DWI PROSECUTION POLICY IN SENECA COUNTY:

 Level: .11 or below

Conditions: No priors, no accident, no children in car, no test refusal, and cooperative.

Evaluation: Required and must comply with, and complete, treatment recommendations prior to disposition.  If appropriate based upon the evaluation, entry into and completion of Drug Court may be required.   A written waiver of speedy trial must be executed.

Other Pleas:  If one or more of the other tickets is for a moving violation, then a plea to at least one of the moving violations in addition to the DWAI plea.

Sentence:  Maximum fine.  CD if the defendant has no priors.  Probation if the present disposition is a reduction from a felony DWI.

Exceptions: Subject to approval of the District Attorney
